Abstract

This chapter explains the respective roles of the Basic Law, the Hong Kong Bill of Rights and the ICCPR in protecting human rights in Hong Kong. It highlights areas of overlap and difference between these three documents. The chapter examines various possible interpretations of Article 39 of the Basic Law. Moreover, it considers the significance of these possible interpretations for the continued protection of human rights (especially civil and political rights) in Hong Kong.
