Compliance theory in development : logical imperatives and a role for justice

    Abstract

    Compliance theory must go beyond the traditional relationship between the regulator and the regulated, to include the relationshipbetween the regulated, the perception each regulated entity has of the regulator's relationship with other entities to whom the regulation applies, and the internal dimension of compliance. Compliance theory should also be tested against concepts in related disciplines. Justice is one of these. Justice, in the broader sense of fairness, has a role to play in each stage of the compliance process―regulation formation, raising industry awareness, monitoring and enforcing compliance—and is likely to play an even greater role in the future.
