Detention without trial : a threat to democratic rights

Abstract

Examination of three High Court decisions in late 2004 relating to detention without trial - potential scope that they have created for the use of indefinite detention - dangers in light of extraordinary powers now granted to the Federal Government and its intelligence police agencies under new counter-terrorism legislation - new dismissive approach to international law, including the International Covenant on Civil and Political Rights.
