Abstract
In administrative practice, an alternative conflict resolution process occurs where disputes arise concerning essential derivation, with Plant Breeder's Rights Australia (the PBR office) mediating between the parties. In addition, there are provisions for decisions on procedure in declaring a variety to be essentially derived to be reviewed by the Commonwealth Administrative Appeals Tribunal (the 'AAT'). Parties not adhering to declarations of essential derivation may commit an offence or be subject to rules of infringement.
