Abstract
The dilemma of climate change brings to light some inadequacies in our justice system as it is primarily orientated to methods of access to justice for present generations of human beings. This can lead to difficulties where the rights of future generations and the environment are substantially affected by the actions of present generations leaving future generations with the inability to access justice in order to protect their rights because they lack standing. One of the areas of significant environmental concern for future generations is the potential for severe and irreversible environmental damage caused by the adverse effects of climate change.
