Abstract
Everyone in the Australian business community awoke in October 2013 to the shocking headlines of the Fairfax Media newspapers that Leighton Holdings has been accused of bribery and corruption of international construction contracts. This article does not specifically focus on the reputational issues nor the current Leightons matter, as that is still subject to a detailed investigation. This legal article deals with the real issues of the complexities of international investigations into alleged criminal behaviour (such as bribery and corruption) and also domestically, the breach of directors' duties for conflicts of interest.
