Abstract
The tort of passing off is concerned with the misappropriation by deception of a trader’s reputation or goodwill. Original, the action was confined to fraudulent attempts by trades to pass off their goods as those of another. However, it has expanded over time to any representation that falsely suggests some connection with another person’s product or business.
