    Abstract

    Enforceable undertakings (EU) are an important enforcement tool that is at the disposal of ASIC to help encourage companies to comply with the Corporations Act 2001. In Part 1 (Keeping good companies, June 2007) of this article we discussed the definitional aspects of EUs, the circumstances when ASIC will enter into an EU and the content of such agreements. Part 2 focuses on the characteristics of the various EUs granted by companies and individual officers, as well as the actual enforcement by the courts of such agreements.
